Terms of Service

Introduction.

The Terms of Service, Privacy Policy and the standards referred to within them, form a binding legal agreement between you and Kampspire® that governs your right to use the websites, applications, and other offerings from Kampspire® (collectively, the “Kampspire Platform”).

By using Kampspire®, you acknowledge that you have read, understood, and agreed to the Terms of Service and Privacy Policy.

Intellectual property and trademarks

“Kampspire” and the Kampspire flame logo are registered trademarks in several jurisdictions. “Shadow Load” and “The Parent Side Quest” are proprietary marks and may be subject to pending trademark registration.

All content on the Kampspire platform, including but not limited to text, editorial materials, system maps, frameworks, concepts, designs, graphics, logos, and branding elements, is protected by copyright, trademark, and other applicable intellectual property laws.

Unauthorized use, reproduction, modification, distribution, or commercial exploitation of Kampspire intellectual property without prior written permission is prohibited.

Definitions

Platform.

Refers to the websites, applications, and other offerings from Kampspire.

User(s).

Refers to anyone using the platform, including but not limited to camps, advertisers, and individuals searching for or interacting with camp brand pages. This includes general accounts.

Camp(s).

Refers to camps or any other organisations that list their services on Kampspire.

Subscription(s).

Refers to the paid or free options chosen by camps to advertise their brand pages on the platform.

General Use.

Platform service.

Kampspire is an online platform that facilitates the publication of camp brand pages and allows users to search, explore and contact camps. Kampspire does not own, operate, or manage any of the camps listed on the platform. The platform is provided as a means of connecting camps with users seeking camp services, but Kampspire does not control, endorse, or guarantee the quality, suitability, safety, or legality of any camps or services offered.

User and Camp Responsibilities

  • Camps.

    Camps are solely responsible for the accuracy and completeness of the information they provide, including their services, pricing, certifications, and availability. Kampspire does not verify or guarantee the truthfulness of the information provided by camps.

  • Users.

    Users are responsible for their own decisions and actions when interacting with camps. Any communication, agreement, or transaction between users and camps is conducted independently of Kampspire, and Kampspire is not responsible for any outcomes, disputes, or issues arising from such interactions.

Limited role.

Kampspire’s role is limited to providing an online space for camps and users to connect. Kampspire does not:

  • Participate in or influence any agreements, bookings, or transactions between users and camps.

  • Mediate or resolve disputes between users and camps.

  • Ensure or guarantee the performance or availability of any camp or camp services.

  • Provide refunds or compensation for unsatisfactory camp experiences or any issues related to camp brand pages.

Risk Assumption.

By using Kampspire, you acknowledge that you do so at your own risk. It is your responsibility to assess the accuracy, legitimacy, and suitability of any camps or services listed on the platform, and to take appropriate precautions when engaging with camps.

No liability for camps or third-party incidents.

Kampspire is not responsible for any acts, omissions, or incidents that occur at any camp listed on the platform. Any injury, property loss, misconduct, or other issues that occur at a camp are the sole responsibility of the camp and the parent or guardian. By using Kampspire, you agree that Kampspire is not liable for any claims, damages, or disputes arising from your participation in, or your child’s participation in, any camp listed on the platform.

Limitation of liability and no affiliation with camps.

These terms apply globally, including camps located in Australia, the United States, Canada, and elsewhere. Kampspire is not a party to any agreement, booking, or transaction between users and camps. All arrangements occur strictly between the user and the camp. Kampspire does not operate, manage, control, supervise, inspect, or oversee any camps or their activities.

  • Users must independently verify all information. Kampspire makes no guarantee that brand pages, pricing, dates, descriptions, accreditation claims, policies, or imagery are accurate or up-to-date. Refer to the camp’s official website for current information.

  • Kampspire is not responsible for any injury, loss, damage, misconduct, omission, or failure by any camp, including personal injury, child safety incidents, property loss, financial loss, breach of contract, or operational failures.

  • Kampspire provides no warranties regarding the accuracy, accreditation, safety, staffing, or quality of any camp or camp-generated content.

  • You agree to indemnify Kampspire from claims, losses, or damages arising from your interactions with camps or reliance on inaccurate information.

Global applicability.

These Terms of Service apply to all camps listed on Kampspire, regardless of location. Users acknowledge that local laws and regulations may vary, and Kampspire makes no guarantee that any camp complies with the laws of its jurisdiction.

Platform use and no professional advice

    Informational only:

    All content on Kampspire, including camp descriptions and brand pages, is for general information only. It does not constitute professional advice of any kind, including legal, medical, educational, or financial advice.

    No endorsement:

    The appearance of any camp on Kampspire, whether through a free or paid brand page, does not constitute an endorsement, recommendation, certification, or approval by Kampspire.

    Independent responsibility:

    Users must independently verify all information and conduct their own due diligence before selecting or interacting with any camp. You are solely responsible for your decisions and actions.

    No reliance:

    Kampspire does not guarantee the accuracy, completeness, or timeliness of any information. Any reliance you place on the content of the platform is entirely at your own risk.

    No liability for outcomes:

    Kampspire is not responsible for any injury, loss, damage, or other consequences arising from your use of the platform, interactions with camps, or decisions made based on the information provided.

    Limited role:

    Kampspire does not manage, operate, or control any camps, nor does it participate in or influence bookings, agreements, or transactions between users and camps.

Editorial content, blogs, and camp system maps

Kampspire may publish editorial content, including but not limited to blog articles, field guides, camp system maps, structural descriptions, archetypes, and other interpretive materials.

All such content is provided for general informational and educational purposes only. It is based on publicly available information, camp-submitted materials, general observations, or editorial analysis, and may not reflect the current operations, policies, staffing, safety practices, accreditation status, or conditions of any camp.

Editorial content and camp system maps are descriptive tools only. They do not constitute evaluations, ratings, endorsements, certifications, safety assessments, compliance reviews, professional advice, or guarantees of any kind.

Kampspire does not represent or warrant that any editorial content is complete, accurate, up to date, or suitable for any particular purpose. Users must independently verify all information directly with the relevant camp before making decisions or relying on any content published on the platform.

Kampspire reserves the right to modify, update, or remove editorial content at any time without notice.

Subscriptions.

Paid subscriptions provide enhanced features and visibility. Kampspire does not guarantee enquiries, rankings, visibility levels, or specific outcomes from any subscription plan.

Billing options

Kampspire may offer subscription plans billed monthly or annually. Annual plans may be offered at a discounted rate compared to the equivalent monthly pricing and are billed upfront.

Automatic renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on the selected plan) unless cancelled before the renewal date. By subscribing, you authorize Kampspire, through its payment processor, to charge the applicable subscription fees for each renewal period.

Cancellation

You may cancel your subscription at any time. If you cancel, access to paid features will continue until the end of your current billing period. Your subscription will not renew after that date.

Annual plans

Annual subscriptions are billed in full at the start of the annual term. If you cancel an annual subscription, it will remain active until the end of the annual term. No refunds or credits are provided for unused time except where required by applicable law.

Changes to pricing

Kampspire may modify subscription fees or plan features from time to time. Any changes to fees will apply at the next renewal date. Kampspire will provide reasonable notice of pricing changes before they take effect.

Payments.

Third-Party Payment Processor.

Kampspire uses a third-party payment processor to handle all payments for subscription services and other transactions on the platform. By making a payment on Kampspire, you agree to the terms and conditions of the third-party payment provider, which may include additional fees or requirements specific to their service. Kampspire is not responsible for any issues arising from the payment processor’s services, including but not limited to failed transactions, service interruptions, or unauthorized access to payment information.

No Storage of Payment Information.

Kampspire does not store, collect, or retain any payment information, including credit card numbers, bank details, or any other sensitive financial information. All payment data is securely processed through our third-party payment provider. For any concerns related to your payment method or transaction, you should contact the third-party provider directly.

Payment Obligations.

By subscribing to Kampspire’s paid services, you agree to pay the fees applicable to your chosen subscription plan. All fees are charged in USD (United States Dollars) unless otherwise stated and are non-refundable, including in the event of cancellation or termination of your account or subscription.

Taxes and fees .

Subscription fees may be subject to taxes (including GST, VAT, or sales tax) depending on your location. Your bank or card provider may charge foreign transaction fees or currency conversion fees, which are your responsibility.

Failed or Disputed Transactions.

If a payment is disputed or fails, Kampspire reserves the right to suspend or terminate access to any paid features or services until the payment issue is resolved. You are responsible for resolving any issues directly with the payment provider.

Changes to Payment Terms.

Kampspire reserves the right to modify payment terms or subscription fees from time to time. Any changes to subscription fees will apply at the next billing or renewal date. Kampspire will provide reasonable notice before any pricing changes take effect.

Camp-Generated Content.

Kampspire allows camps to create and maintain brand pages and submit related content. By submitting any content on the platform, you agree to abide by the following terms and conditions. Content refers to material submitted by camps for their brand page, including descriptions, images, videos, pricing, session details, policies, and related materials.

We reserve the right to remove any content, either in part or in full, that violates our Terms of Service or for any other reason at our sole discretion. Repeated or serious violations may result in the restriction, suspension, or removal of the associated Kampspire account. The following types of content are prohibited on Kampspire:

  • Spam, unwanted contact, or content shared disruptively or repeatedly.
  • Content that promotes illegal or harmful activity, or that is sexually explicit, violent, graphic, threatening, or harassing.
  • Content that is discriminatory.
  • Content that impersonates another person, account, or entity, including Kampspire representatives.
  • Content that is illegal or infringes upon another person’s or entity’s rights, including intellectual property and privacy rights.
  • Content that contains private or confidential information.
  • Brand page titles that include irrelevant information unrelated to the camp’s type, or experience, or titles containing symbols or emojis.
  • Brand pages or profiles that provide false, misleading, or deceptive information.
  • Content that harasses, trolls, or repeatedly targets others.

Serious Allegations

Any content submitted to Kampspire that includes accusations of illegal activity, criminal behavior, abuse, or other serious allegations may be removed at Kampspire’s discretion. Such matters should be reported directly to relevant authorities or appropriate regulatory bodies.

Prohibited use regarding children

You may not use the Kampspire platform to promote or facilitate unsafe or illegal activities involving minors, including abuse, exploitation, harassment, or unauthorized sharing of child information or media. Any violations may result in immediate suspension or termination of your account, reporting to authorities, and potential civil or criminal liability.

Camp content, accuracy and responsibility.

Camps may create and maintain a brand page on Kampspire, including descriptions, pricing, session dates, policies, accreditation claims, images, videos, and other related materials.

Camps are solely responsible for ensuring that all content submitted to Kampspire is accurate, current, lawful, and not misleading. Kampspire does not verify, guarantee, or independently audit the accuracy, completeness, legality, safety practices, supervision standards, staffing qualifications, accreditation claims, or compliance of any camp listed on the platform.

Users must independently verify all information directly with the camp before relying on it.

No duty to verify camp content.

Kampspire hosts camp brand pages and related camp-submitted materials. Kampspire does not have a duty to review, verify, or monitor the accuracy, completeness, legality, or timeliness of camp-submitted content, or any communications between users and camps.

User Responsibility.

Camps are responsible for the content they submit. Users are responsible for independently verifying camp information directly with the camp before relying on it. Kampspire does not guarantee that any camp content is accurate, complete, or up to date.

License to use camp content

By uploading or submitting any content, including but not limited to images, videos, logos, or written descriptions, camps grant Kampspire a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, adapt, and publish such content for the purpose of operating, promoting, and improving the Kampspire platform.

Camps represent and warrant that they have all necessary rights, permissions, and consents to upload and license such content.

Child safety, supervision and media

Kampspire does not operate, manage, supervise, inspect, or control any camp or camp activity.

Camps are solely responsible for complying with all applicable child protection, supervision, safety, background check, disability accommodation, and medical regulations in their jurisdiction.

If camps upload images, videos, or other media featuring children, they must obtain all required parental or guardian consents and comply with all applicable privacy and child protection laws. Kampspire does not verify such consents and is not responsible for any misuse of media content by camps.

Parents and guardians are solely responsible for assessing the suitability of any camp for their child and for communicating medical conditions, disabilities, allergies, or other special requirements directly to the camp.

Participation in any camp or program is at the user’s own risk.

Medical and professional disclaimer

Kampspire does not provide medical, healthcare, legal, educational, financial, or professional advice.

All content on the platform is provided for general informational purposes only and should not be relied upon as a substitute for professional consultation. Users must seek advice from qualified professionals where appropriate.

Reporting obligations

Any suspicion of child abuse, neglect, criminal conduct, or unsafe practices at a camp should be reported directly to local authorities or the appropriate regulatory body.

Kampspire does not investigate or adjudicate allegations regarding camps and disclaims liability arising from failure to report or prevent incidents.

How search works.

Search results are influenced by various factors, but Kampspire does not guarantee placement, ranking, or performance of any brand page. The main factors that influence a camp’s position include the quality, popularity, and location of the camp. Our system also ensures randomization in search results, so users are presented with different camps, offering a range of experiences, prices, and locations.

Quality.

The quality of each camp brand page is determined by various details like camp photos, videos, staff profiles, session and pricing information, and videos (some of these are Pro features). Camps with more complete brand pages, clearer session and pricing information, and higher quality media may appear more prominently in search results.

Popularity.

Search results may reflect user interactions with brand pages and other internal relevance signals determined by Kampspire. These signals may change over time.

Location.

Camps located in popular regions, or near renowned summer camp areas tend to get higher visibility based on higher frequency of search.

Using search filters.

To help users refine their searches, Kampspire provides various filters. You can narrow your results by camp category, gender, location, price range, activities, and more. Additionally, we offer a map view to help users see the geographic distribution of camps that match their preferences.

How Users Influence Search Results.

When users enter details like location, activities, categories, the algorithm refines the results based on that information. Users can further refine results using filters like gender, age, price & stay options. If there aren’t enough exact matches for a user’s criteria, we may show alternative camps that closely match their preferences based on factors like price, location, or activities.

Note: Our ranking algorithms will evolve over time to reflect changes to our business, technology and to improve the user experience.

False Claims of Accreditation.

Camps using the Kampspire platform must accurately represent their accreditation status. Any claims of certification or accreditation by recognised bodies (e.g., American Camps Association, Canadian Camping Association, YMCA, Australian Camps Association, or any other professional or regulatory organizations) must be truthful and verifiable.

Prohibited Misrepresentation.

Camp owners are prohibited from falsely claiming to be accredited, certified, or endorsed by any regulatory body, association, or organization they are not legitimately affiliated with.

Enforcement.

Kampspire reserves the right to remove or suspend any camp brand page that makes false accreditation claims, misrepresents its credentials or fails to provide sufficient evidence of accreditations.

Messaging.

  • Kampspire may provide contact links or contact forms that enable users to contact camps. Communications occur between the user and the camp. Kampspire does not monitor or moderate communications between users and camps and is not responsible for any outcomes arising from those communications.

  • Prohibited Use: The messaging function cannot be used for spamming, solicitation, harassment, or any unlawful purposes.

Disclaimer of Warranty.

Kampspire provides the platform "as-is" and "as available" without any warranties, either express or implied. We do not guarantee that the platform will be free from errors, uninterrupted, or that all brand pages are accurate or up to date.

Limitations of liability

To the maximum extent permitted by law, Kampspire, its parent company, subsidiaries, affiliates, directors, officers, employees, contractors, agents, licensors, service providers, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, business opportunities, or other intangible losses, even if Kampspire has been advised of the possibility of such damages, arising out of or related to:

Use or inability to use the platform

Your access to, use of, or inability to use the platform, including any errors, omissions, or interruptions in services, delays in transmission, system failures, or unauthorized access to Kampspire’s servers or data.

Content accuracy

Any content posted or submitted by users or camps, including but not limited to, any false, inaccurate, defamatory, misleading, offensive, or unlawful content available on the platform.

Third-party websites and services

Any third-party links, websites, services, or resources accessed through Kampspire, including any interactions, transactions, or communications with such third-party sites. Kampspire is not responsible for the actions or omissions of third-party websites or services linked through the platform.

Subscription services

Any issues related to the subscription services offered to camps, including any claims of non-performance, unavailability, or lack of results. All subscription fees are non-refundable, and Kampspire is not liable for any loss or dissatisfaction resulting from the termination or modification of your subscription.

Security breaches

Any unauthorized access, hacking, tampering, or breaches of security that affect your use of the platform or your personal data, except where such breaches are due to Kampspire’s gross negligence or wilful misconduct.

Loss of data or damage to devices

Any damage to your devices, systems, or loss of data that results from the download, installation, or use of the platform or any linked third-party software, content, or services.

Legal actions or claims

Any legal actions, claims, disputes, or penalties arising from your use of the platform, including claims related to intellectual property infringement, defamation, violation of privacy, or other unlawful activities conducted on or via Kampspire.

Changes to the platform

Any modification, suspension, discontinuation, or termination of the platform or any services offered through Kampspire, whether temporary or permanent, without prior notice.

No liability for camps or third-party incidents

Kampspire does not operate, control, endorse, or supervise any camps, activities, or services listed on the platform. You acknowledge that participation in any camp, program, or third-party service involves inherent risks, including personal injury, property damage, or other incidents. Kampspire is not liable for any loss, injury, or damage arising from your engagement with camps, programs, or third-party services.

Global applicability

These limitations apply worldwide, regardless of where you access the platform or engage with camps and third-party services. You agree that Kampspire’s liability shall be limited to the fullest extent permitted by applicable law in your jurisdiction.

Maximum liability cap

In no event shall Kampspire's aggregate liability to you for any and all claims arising from your use of the platform exceed the total amount, if any, paid by you to Kampspire during the six (6) months prior to the event giving rise to the claim. If no such payments have been made, Kampspire’s liability shall be limited to AUD $100.

Exclusions

Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above exclusions or limitations may not apply to you. However, in such jurisdictions, Kampspire’s liability will be limited to the fullest extent permitted by law.

Survival

These limitations of liability shall survive the termination or expiration of these Terms of Service and your use of the platform.

Indemnification.

By using the Kampspire platform, you agree to indemnify, defend, and hold harmless Kampspire, its parent company, subsidiaries, affiliates, directors, officers, employees, contractors, agents, licensors, service providers, and suppliers from and against any and all claims, liabilities, damages, losses, costs, or expenses, including but not limited to reasonable legal fees, arising from or related to:

Your Use of the Platform.

Any use of the Kampspire platform, including but not limited to, your violation of these Terms of Service, or any applicable laws, regulations, or third-party rights.

Camp-Generated Content.

Any content you submit, post, or transmit on the platform, including but not limited to, claims arising from any false, defamatory, offensive, or illegal content you provide, as well as any claims related to intellectual property infringement or the violation of privacy rights.

Third-Party Links and Interactions.

Any damage or loss caused by your reliance on or interaction with third-party websites, resources, services, or users, which are accessed via links provided on the platform.

Violation of Accreditation Claims.

Any misrepresentation or fraudulent claims of accreditation, certification, or endorsement by any regulatory body, association, or organization that you or your camp are not legitimately affiliated with.

Breach of Contract.

Any breach or violation of any contractual obligations with third parties, including but not limited to, other users, camps, or service providers, arising from your use of the platform or any services connected to Kampspire.

Security Breaches.

Any damages or liabilities arising from your unauthorized use of automated tools, such as robots, scrapers, or data-mining technologies, to access or use Kampspire’s platform or content.

Technology Misuse.

Any damage to your devices, systems, or loss of data that results from the download, installation, or use of the platform or any linked third-party software, content, or services.

Legal Disputes.

Any and all legal disputes, settlements, penalties, fines, or judgments resulting from your actions, use of the platform, or failure to comply with the terms, whether directly or indirectly.

Scope of Indemnity.

This indemnity obligation extends to and includes any claims brought against Kampspire by any third party, regulatory body, or law enforcement agency due to your actions or inactions on the platform, including, but not limited to, those relating to intellectual property infringement, defamation, violation of privacy, and illegal or unauthorized activities.

Costs and Fees.

You agree to promptly reimburse Kampspire for any legal fees, costs, or expenses incurred in defending against such claims or enforcing this indemnification provision. Kampspire reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with our defence of such claims.

Survival.

This indemnification provision shall survive the termination or expiration of these Terms of Service and your use of the platform.

Force majeure

Kampspire shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, acts of God, pandemics, government actions, labor disputes, internet outages, or other unforeseen circumstances. This includes any inability of camps to operate or deliver services as expected.

Termination

Kampspire reserves the right to terminate or suspend your account at its sole discretion if you violate these terms or engage in any unlawful or prohibited activities on the platform.

Intellectual Property and Restrictions on Use.

Ownership.

All content on Kampspire, including but not limited to text, images, designs, code, and other media, is the property of Kampspire or its licensors, unless otherwise indicated. This content is protected by copyright, trademark, and other intellectual property laws.

  • Prohibited Use.

    • Reproduce, copy, distribute, transmit, publicly display, or perform any content from Kampspire without prior written consent from Kampspire.
    • Use the platform’s content for any commercial purposes or public displays (commercial or non-commercial) without express permission.
      • Modify or alter any part of the platform, reverse-engineer the platform’s code, or attempt to extract the source code.

Prohibited Use of Automated Systems.

No Scraping, Crawling, or Bots.

You are prohibited from using any robot, spider, scraper, or other automated means to access, copy, or collect data from Kampspire for any purpose without prior written permission.

No AI or Machine Learning Extraction.

You must not use any form of artificial intelligence (AI), machine learning, or other data extraction technologies to mine, analyze, or retrieve any information or content from Kampspire’s platform.

Governing Law.

These Terms of Service are governed by and construed in accordance with the laws of Australia. Any disputes arising from the use of the platform shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Changes to Terms.

Kampspire may update these Terms of Service and the Privacy Policy from time to time. Any changes will be posted on this page, and your continued use of the platform constitutes acceptance of the updated terms.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
